These Terms and Conditions (“Terms”) govern your access to and use of the OnSight Payments platform, websites, mobile experiences, customer portal, and related services (together, the “Services”), operated by Hanson & Bosley LLC (“OnSight Payments,” “we,” “us,” or “our”). By creating an account, using the Services, or receiving messages from us, you agree to these Terms.
01 · Who this is for
OnSight Payments is a field service and billing platform used by service businesses in the United States — including landscaping, HVAC, plumbing, pest control, and auto repair — to send estimates and invoices, take payments, schedule visits, and communicate with their own customers.
Two kinds of people use the Services:
Where a business user sends a communication through the Services, that business is responsible for the content of the communication and for holding the consent required to send it. OnSight Payments provides the platform and transmits the message.

03 · Messaging program
The OnSight Payments messaging program sends text messages to (a) staff of business users, for account security and platform notices, and (b) customers of business users who have consented to receive text messages from the business they deal with. Messages are sent from a number operated by OnSight Payments, and each customer-facing message identifies the business the recipient does business with.
You will only receive text messages from a business using OnSight Payments if you have given that business your mobile number and agreed to be contacted by text. Consent is recorded before any message is sent. Consent to receive promotional text messages is not a condition of purchasing any goods or services.
Message frequency varies and depends on your activity with the business you deal with — for example, how often you book work or receive an invoice. Most recipients receive fewer than 10 messages per month.
Message and data rates may apply. OnSight Payments does not charge you for these messages; your mobile carrier’s standard rates apply.
Reply STOP to any message to stop receiving text messages from that sender. You will receive one confirmation message and then no further texts. You may also ask the business directly, or contact us at support@onsightpayments.com. Opting out of text messages does not stop email or paper communications, and does not cancel any service or invoice.

Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier, device, and coverage. Supported carriers may change without notice.
Mobile phone numbers collected for text messaging are used only to deliver the messages described above. We do not sell, rent, or share mobile numbers or SMS consent with third parties or affiliates for their own marketing purposes. See our Privacy Policy.

You agree not to use the Services to: send unlawful, deceptive, harassing, or unsolicited messages; message anyone who has not consented or who has opted out; send content prohibited by mobile carriers, including content relating to cannabis, illegal substances, firearms, high-risk lending, or sexually explicit material; misrepresent the identity of the sender; upload contact lists you do not have permission to message; or attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
We may suspend messaging or account access where we reasonably believe these rules, applicable law, or mobile carrier requirements have been breached.
06 · Ownership
Business users retain ownership of the customer, job, and billing data they enter. We process that data to provide the Services, as described in our Privacy Policy. Business users are responsible for having a lawful basis to provide us with their customers’ contact details.
07 · Third parties
The Services rely on third parties including payment gateways, messaging carriers, mapping providers, and accounting integrations. Your use of those features may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
08 · Availability
We aim to keep the Services available but do not guarantee uninterrupted access. We may modify, add, or remove features. If we make a material change to these Terms, we will update the date at the top of this page and, where appropriate, notify account holders.
09 · Disclaimers
Except as expressly stated, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10 · Liability
To the maximum extent permitted by law, Hanson & Bosley LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or relating to the Services will not exceed the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.
11 · Indemnity
Business users agree to indemnify and hold harmless Hanson & Bosley LLC from claims arising out of messages they send through the Services, the consent they represent they hold, and their use of customer data.
12 · Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or where required by law or by a carrier or payment partner. On termination, business users may request an export of their data for 30 days.
13 · Law
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of laws rules. The exclusive venue for disputes is the state and federal courts located in Douglas County, Nebraska.
